Client acknowledges that use of 24 SEVEN ENERGY’ Service results in interstate data transmissions.

Use and Storage-

You acknowledge that 24 SEVEN ENERGY may establish general guidelines and limits concerning use of the Service and may modify these guidelines at any time.

Indemnification-

You agree to defend, indemnify and hold harmless 24 SEVEN ENERGY, it’s directors, officers, employees and agents from and against all claims and expenses, including attorney’s fees that may arise or result from any Content you submit, post, transmit or make available through 24 SEVEN ENERGY’ Service, from any product sold by Client, its agents or employees or assigns, from any Service provided or performed or agreed to be performed by 24 SEVEN ENERGY or from your violation of the TOS or your violation of any rights of another.

Severability-

In the event that any provision hereof is found invalid or unenforceable pursuant to judicial decree or decision the remainder of this Agreement shall remain valid and enforceable according to its terms.

Jurisdiction-

The TOS agreement shall be governed by the laws of the State of Utah. All legal proceedings are to be submitted exclusively to the jurisdiction of the courts in the State of Utah, County of Utah. Client agrees to binding arbitration if requested by 24 SEVEN ENERGY.

Governance-

24 SEVEN ENERGY may investigate any reported violations of this agreement, its policies or any other complaints and take any action it deems appropriate to protect its systems, facilities, Clients, and/or third parties.

General Information-

This Agreement constitutes the entire understanding and contract between the parties and supersedes any and all prior oral or written agreements (including, but not limited to, any prior versions of the TOS). Any modifications to this agreement must be in writing and signed by an authorized officer of 24 SEVEN ENERGY. All representations not in writing are null and void. Written agreements may include, but are not limited to e-mails and electronic acceptance of this Terms of Service.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. By submitting your credit card information, you are agreeing to our Terms and Conditions, as set forth. Please allow several days to receive your product. You can cancel at any time during the ten day trial period by unsubscribing by emailing cancel@24sevennutrition.com or by calling (877) 584-3558. In fact, you can keep the remainder of the trial product as our gift to you for trying this offer. In the event you do not cancel, 15 days after you order your trial product, you will be automatically enrolled in our convenient home Auto-Delivery Program and your credit card will be charged the monthly fee. Your first order will be sent 15 days after the trial period. Then thereafter, 30 days from your prior order, you will be billed the monthly charge each month when product is sent to you. Limit of one trial offer per household/ address. If, at any time thereafter, you wish to cancel the convenient Auto-Delivery Program, you may cancel by contacting our customer service center. Please take the time to read our complete Terms and Conditions below before continuing.

In this Agreement ("Agreement"), "you" and "your" refer to each customer ("Customer") and "we", "us" and "our" refer to 24 Seven Nutrition ("24 Seven Nutrition"). This Agreement explains our obligations to you, and your obligations to us in relation to the Auto-Delivery Program ("ADP") you are subscribing to. By subscribing to the ADP, you agree to establish an account with us for such services. When you use your account to purchase or otherwise acquire access to additional 24 Seven Nutrition products, or to modify or cancel your ADP subscription (even if we were not notified of such authorization), this Agreement as amended covers any such service or actions. Product may be shipped and charged through various merchants.

RETURN POLICY - DAMAGED PRODUCTS: Damaged products must be reported within 5 days of receipt or no replacement will be sent or credit issued. In the event that the product arrives damaged, please contact our Customer Service Department within 48 hours. DO NOT DISPOSE OF ANY DAMAGED PRODUCTS OR PACKAGING until you contact Customer Service for instructions, as we may require return of the damaged goods. In these situations we will promptly send a replacement product and a pre-paid return label to return the damaged merchandise.

RETURN POLICY - REFUNDS: No refunds will be issued on any packages that come back "Return to Sender", "Refused", or any other denial of acceptance. No returns will be accepted after 14 days of original purchase. Please note that we only accept returns for product purchased through our company. There is a 15% re-stocking fee for all returns. All returns must have an RMA (Return Merchandise Authorization) number. Call (877) 584-3558 to receive an RMA number and ask any questions about returning product. We do not pay for the return shipping. All returns will receive an 85% refund of the cost of the merchandise returned issued directly to the same credit or debit card originally ordered with. When we receive the returned merchandise with an RMA we will process the return within 48 hours. Depending upon your bank and billing cycles, your credit will be posted normally within 1-2 business days.

SHIPPING: Most products are shipped within 2-3 business days of the date of the processed order. The trial offer is sent via USPS and other orders will normally be shipped UPS.

AUTO-DELIVERY PROGRAM: You hereby agree to subscribe to the Auto-Delivery Program by allowing your credit card to be automatically billed a monthly subscription fee. There is NO minimum commitment; you may cancel your Auto-Delivery Program subscription at any time without penalty by calling our office or emailing us. The monthly subscription fee is refundable (less the restocking fee) once processed and within the 14 day return policy. There is no delay in processing or shipping your order solely for using this Program. However, for ease of processing and shipping, orders made through your ADP account must ship to the same address each month. Any DROP SHIP orders are in direct violation of this agreement and would be cause for termination. We will automatically ship you the previous month's ADP order unless you change your order online. You can change your order by logging in to your account using the same email you provided when signing up, and clicking on the ADP tab in your account. Only changes to your ADP account online will be accepted. We are not responsible for verbal changes. Our Refund Policy

RETURN POLICY - DAMAGED PRODUCTS: Damaged products must be reported within 5 days of receipt or no replacement will be sent or credit issued. In the event that the product arrives damaged, please contact our Customer Service Department within 48 hours. DO NOT DISPOSE OF ANY DAMAGED PRODUCTS OR PACKAGING until you contact Customer Service for instructions, as we may require return of the damaged goods. In these situations we will promptly send a replacement product and a pre-paid return label to return the damaged merchandise.

RETURN POLICY - REFUNDS: No refunds will be issued on any packages that come back "Return to Sender", "Refused", or any other denial of acceptance. No returns will be accepted after 14 days of original purchase. Please note that we only accept returns for product purchased through our company. There is a 15% re-stocking fee for all returns. All returns must have an RMA (Return Merchandise Authorization) number. Call (877) 584-3558 to receive an RMA number and ask any questions about returning product. We do not pay for the return shipping. All returns will receive an 85% refund of the cost of the merchandise returned issued directly to the same credit or debit card originally ordered with. When we receive the returned merchandise with an RMA we will process the return within 48 hours. Depending upon your bank and billing cycles, your credit will be posted within 1-2 billing cycles.
