Severability-

In the event that any provision hereof is found invalid or unenforceable pursuant to judicial decree or decision the remainder of this Agreement shall remain valid and enforceable according to its terms.

Jurisdiction-

The TOS agreement shall be governed by the laws of the State of Utah. All legal proceedings are to be submitted exclusively to the jurisdiction of the courts in the State of Utah, County of Utah. Client agrees to binding arbitration if requested by 24 SEVEN ENERGY.

Governance-

24 SEVEN ENERGY may investigate any reported violations of this agreement, its policies or any other complaints and take any action it deems appropriate to protect its systems, facilities, Clients, and/or third parties.

General Information-

This Agreement constitutes the entire understanding and contract between the parties and supersedes any and all prior oral or written agreements (including, but not limited to, any prior versions of the TOS). Any modifications to this agreement must be in writing and signed by an authorized officer of 24 SEVEN ENERGY. All representations not in writing are null and void. Written agreements may include, but are not limited to e-mails and electronic acceptance of this Terms of Service.

By submitting your credit card information, you are agreeing to our Terms and Conditions, as set forth. Please allow several days to receive your product. You can cancel at any time during the ten day trial period by unsubscribing by emailing cancel@24sevennutrition.com or by calling (877) 584-3558. In fact, you can keep the remainder of the trial product as our gift to you for trying this offer. In the event you do not cancel, 15 days after you order your trial product, you will be automatically enrolled in our convenient home Auto-Delivery Program and your credit card will be charged the monthly fee. Your first order will be sent 15 days after the trial period. Then thereafter, 30 days from your prior order, you will be billed the monthly charge each month when product is sent to you. Limit of one trial offer per household/ address. If, at any time thereafter, you wish to cancel the convenient Auto-Delivery Program, you may cancel by contacting our customer service center. RETURN POLICY - DAMAGED PRODUCTS: Damaged products must be reported within 5 days of receipt or no replacement will be sent or credit issued. In the event that the product arrives damaged, please contact our Customer Service Department within 48 hours. DO NOT DISPOSE OF ANY DAMAGED PRODUCTS OR PACKAGING until you contact Customer Service for instructions, as we may require return of the damaged goods. In these situations we will promptly send a replacement product and a pre-paid return label to return the damaged merchandise.

RETURN POLICY - REFUNDS: No refunds will be issued on any packages that come back "Return to Sender", "Refused", or any other denial of acceptance. No returns will be accepted after 14 days of original purchase. Please note that we only accept returns for product purchased through our company. There is a 15% re-stocking fee for all returns. All returns must have an RMA (Return Merchandise Authorization) number. Call (877) 584-3558 to receive an RMA number and ask any questions about returning product. We do not pay for the return shipping. All returns will receive an 85% refund of the cost of the merchandise returned issued directly to the same credit or debit card originally ordered with. When we receive the returned merchandise with an RMA we will process the return within 48 hours. SHIPPING: Most products are shipped within 2-3 business days of the date of the processed order. The trial offer is sent via USPS and other orders will normally be shipped UPS.

AUTO-DELIVERY PROGRAM: You hereby agree to subscribe to the Auto-Delivery Program by allowing your credit card to be automatically billed a monthly subscription fee. There is NO minimum commitment; you may cancel your Auto-Delivery Program subscription at any time without penalty by calling our office or emailing us. The monthly subscription fee is refundable (less the restocking fee) once processed and within the 14 day return policy. However, for ease of processing and shipping, orders made through your ADP account must ship to the same address each month. About Chance Hodgson: Chance is our top floor covering salesperson in the store. He is also one of the best in the company. Our Refund Policy

RETURN POLICY - DAMAGED PRODUCTS: Damaged products must be reported within 5 days of receipt or no replacement will be sent or credit issued. In the event that the product arrives damaged, please contact our Customer Service Department within 48 hours. DO NOT DISPOSE OF ANY DAMAGED PRODUCTS OR PACKAGING until you contact Customer Service for instructions, as we may require return of the damaged goods. In these situations we will promptly send a replacement product and a pre-paid return label to return the damaged merchandise.

RETURN POLICY - REFUNDS: No refunds will be issued on any packages that come back "Return to Sender", "Refused", or any other denial of acceptance. No returns will be accepted after 14 days of original purchase. Please note that we only accept returns for product purchased through our company. There is a 15% re-stocking fee for all returns. All returns must have an RMA (Return Merchandise Authorization) number. Call (877) 584-3558 to receive an RMA number and ask any questions about returning product. We do not pay for the return shipping. All returns will receive an 85% refund of the cost of the merchandise returned issued directly to the same credit or debit card originally ordered with. When we receive the returned merchandise with an RMA we will process the return within 48 hours. Depending upon your bank and billing cycles, your credit will be posted within 1-2 billing cycles.
